OK, coming to the point, how did you open 2nd SR within a week. Did you get any response for the 1st SR or 2nd SR at all? If so, what was it?

On Aug 11, 2007 - I 140 Denied Due to Ability To Pay issues
Description for denial ( I have also attached the denial notice)->
They looked at years 2003 to 2006 history for I140 since PD is JAN 03.
* Reason 1 - Lower salary than specified in labor
Preferred Wage in labor - 78,750
W2(2003) - $76,850; W2(2004) - $75,638; W2(2005) - $31,652;
W2 for 2005 is less due to company merger. I have another W2 from new company for 2005. I moved to another company due to merger but lawyer continued GC throgh old employer since the both companies exists after the merger.
* Reason 2 - negative net income of the petitioner
2003 (-$537,841); 2004(-$445,493); 2005(-$527,298); 2006(Not Submitted);
* Reason 3 - 2003 and 2004 OK but net current assets are -ve in 2005
and my lawyer did not provide 2006 information
Acceptable Assets Aceptable Liabilities Net Current Assets
2003 $4,272,733 $3,789,359 $483,374
2004 $4,871,615 $4,660,879 $210,736

Your application was denied not with a combination of
Reason 1 , 2 & 3, but each reason by itself was insufficient to prove ability to pay. Your employer should meet atleast one of these to prove "Ability to Pay".
It's deplorable that most attorney's don't educate small employers on meeting ability to pay even before filing the Labor Certification.
I would suggest that you appeal the case with supporting statements from a good CPA and in the meantime go for a fresh labor certification.

For eg.. I was talking to my friend in India and told him about the issues here, he did not understand, he thought I am having a tough time here and told me he has some friends in US who can help me out with immigration problems. When I explained our issues to some people here, some understood and some did not, they told me they know some lawyers who are very good and can help. One of my old employer started a new company in Atlanta and contacted me and asked me to join, but I told him I cannot because I am stuck with my ppresent employer and will lose priority date blah... he did not understand that and was confused.
I had the SAME exact problem, both, with people here (indian citizens who are now american citizens) and people back home. To the point where, once i was addressing a group of my community members and a couple of Indian american people absolutely REFUSED to belive that the Govt wud give illegals a better break than they wud give us, and that it had happened in the past. It took me half an hour and quite a few examples to illustrate how that was true.

- 2004 filed for Labor and started EB3 process.
- Company got acquired in later years . Filed new I140 ( I think it is called successor-in-interest)
- Recently started fresh EB2 process for interfiling of EB3 to EB2 . GC approved.

But my fight for what is fair is distinct from my own case and i am gonna keep going.
Bcoz Mr. gctest is Mr. phd, he treats Eb3 with contempt! Now, he will go back and delete all his dirty posts :)

Seriously, folks. What's with this thread? Total waste of time.
Someone announces his 'greatest achievement' ... others challenge him to show true patriotism... yet others ask him to continue supporting India etc., AND this chap actually responds :)!
Wow! Seriously we all have too much time on our hands to be self promoting / congratulating / reminiscing etc...
Glad that this person will call US Senators etc., lets thank him for that and keep moving... instead of grilling him on things that matter to you! He owes you all no explanations or apologies.

here is what i have figured out in last 4 year and i have been to various blogs.
1. i have read various blogs all are saying trading options with all good stuff you can hardly make any money. Most of the term you have used i have some idea what its is , but havent studied it properly.
2. trading is gambling- you can have some edge by stastical analysis what have performed well over a long time. so backtest u r system over 10 years.
3. would like to know what kind returns are you targeting with options
4. spreads can be an way to go ..but has to be directional bet or else difficult. I have seen lot of iron condor guys breaking down in recent melt down and up.
5. so i kind of believe in hit and run and momentum play - what else can make you money where nothing is certain
6. buying when rsi2 is depressed and selling quickly - can be spread havent back tested it.
i backtest using stockfetcher. but u cant backtest options, you have to manually do it. itried some using think or swim platform.
so i am trying to see if anybody else has any good strategy to share.

I used ICICI for 7 years....was always ok with the serivce ...did not have anything much to complain....
I did not know about SBI service being available....a few days back someone on IV forum told me to try SBI....I tried it out....
If ICICI charged me 50 paise per dollor SBI charged only 25 paise per dollor....(come one it is not free with anyone... -;)
I used SBI twice so far.....quite happy.....more over feel glad to use a nationalised bank -:)
compared to ICICI ...on a different note....my wife opened an NRI account with ICICI 5 years back and since then I have been trying to add myself as a joint acount holder....starngely ICICI's "excellent" customer service has not yet been able to do it....:confused:....I might as well give up....lol...

Go to their website and look for consitutent services. Utilize their services ONLY if your's is a genuine problem and follow their instructions - write clearly what your problem is and what kind of help you are expecting. Spome of them are very helpful - they stay on top of the case till they get you a written decision

I believe you have to file an amendment to let USCIS know that you intend to continue on H1B after you return using AP OR file for an H1B extension if you are within that timeframe before a transfer.
AFAIK, when you return on AP, you are paroled into the US and the I-94 you get is valid only for the term of your AP. When you send that I94 copy across to USCIS for your H1B transfer, you may have an issue.
I believe this is just procedural since I have seen a lot of people continue working on their H1B for their current employer (Same as GC) after using AP and they have not had any issues.

Please remember that ICICI gives LIMITED coverage for anyone above the age of 56. It is mentioned in the "fine print". They have a restriction of say $1200 per day of hospitalization (not sure of the exact amount- but somewhere in that region).
The same is true for TATA Travelguard
It sounds like Comprehensive Insurance from a US company might provide the best "insurance"
Don't ever go with ICICI Lombard, they are jerks and cheaters, I took it for my mother and they have not educated her properly while taking insurance from them, when it comes to claim, they have given penny, saying they have applied sublimits in her claim, and they took too much time to pass a claim of a chunk, I really hate this company, don't go with them,
