Did anyone notice that GCTest's only interest was to start a fight between EB2 and EB3 folks.
See how he opened up a thread and threw a match to light the fire so that everyone starts fighting amongst themselves and he did not post again in his own thread .

If it is India EB2, then yes, but I guess once ROW eb3 becomes current, we can see unused visas flowing in from all directions (Just a speculation) and PDss may move afster. But forr now, God knows when the PD will move.

i know its pretty lame, but what i would really like would be a regular black ipod, and i dont mean that u2 crap, with the wierd red and signatures on the back.
I like the red and black, but I don't like the signatures... I wish it was black all the way around the back. That would be perfect and it *might* actually make me want to get an ipod.

It's not just 180 daysd before the application, it also includes 180 days AFTER the application.
This is the current section on 90 days period
(E)(i) In the case of an application described in clause (ii),
the employer did not displace and will not displace a United States
worker (as defined in paragraph (4)) employed by the employer within
the period beginning 90 days before and ending 90 days after the
date of filing of any visa petition supported by the application.
And the ammendment in the new bill
(1) NONDISPLACEMENT.--Subparagraph (E) of such section 212(n)(1) is amended--
(A) in clause (i)--
(i) by striking ``90 days'' both places it appears and inserting ``180 days'';
Yes, that is my understanding at this point based on the language . As soon as the bill goes into effect, you will need to stop working at the client site if the bill passes in its current form AND you are working as a FT employee (w-2) of a mere placement company (aka agent or desi consulting). If you are an FT employee of big consulting company then until they get waiver for you AND your current client proves that no layoffs were done at the client site in the last 180 days, you will need to stop working.

You can keep your PD if your 140 is approved from your current employer. I know of a person who did this succesfully.
Can you please elaborate on how this can be achieved? I curently have an approved 140 and am stuck in EB3 retrogression.

You are hitting the right buttons here! You can say it is either laziness or fright/jitters or the comfort of current H1B approval/stamp that is making the large populace to sit tight.
Guess what, once some of the battles are won (we can never win all - they will always be ongoing), we should either knight pappu or induct him to "IV Hall of Fame".

I just want IV to be remembered for getting rid of retrogression and solving the GC problems that plague hundreds of thousands of high skilled immigrants. each and every member of IV is important in order to achive this. one member or even the entire core cannot do it alone if there is no support and efforts from IV members. IV members are more important than one member in this struggle.

Did you keep new filing fee also? When I spoke to custumer service by 800 number call, she said you have to keep new check and original sealed medical along with duplicat filing.Wish you all the best!
Same as me :D but for the fact that I sent in mine without medical. What do you guys think the chances are of USCIS sending an RFE instead of rejecting the application outright?
Btw..I did "re-file" with completed medical yesterday. I am just hoping they accept my July 2 app. to avail, if any, advantages of RD.

Great work IV for making this happen. But I agree with the concerns of backlogged EAD/AP. I think we should work with USCIS towards issuing interim EADs atleast . Else it will take 1-2 years just to get a receipt...That would defeat our purpose.
So what did we acheive? Just moved the backlog from "waiting to file I-485 to waiting for EAD" ? And I am not even talking about getting the GC .Who knows when we will get that?

Many in IV will know that I have never opposed legal porting. However, I disagree that this is a way to get out of the mess. There is a fixed total number of Visa available. Per current rule this first comes to EB2 and is consumed completely leaving nothing for EB 3. If all (or majority) EB 3 moves to EB 2, the chocking will be in EB2 . So the "mess" just shifts its position.
The true way is -- 1) Recapture, 2) Exclude dependents from Visa Number
As I see it, the only persons benefited are the ones having the priority dates in ancient times. I think we really should not mind letting them have their GC's, being our seniors.
Yes, later year porters might end up having to wait. It's all in the game, fortunately or unfortunately. One thing is for sure, we as a whole, have an uphill battle
If it really comes to matter, I think it should be easy for an EB2 to port to EB3 if the dates are current for him in the different category. So if I were EB2 today, I wouldn't be so apprehensive :)
