    I went through the PDF and I am surprised at the facts listed in the section:

    In this section they cited the Computer Analyst example and I am afraid this WILL IMPACT every consulting company.:mad:

    VERY VERY BAD and DIRECT descrimination.

    I wonder how these USCIS people decide internally the labor practices like that...

    My company got an RFE for ability to pay from USCIS. we are responding back with my companies 2006 tax returns and w-2 which shows more than proffered wage determined by Dept of Labor during PERM. I hope this should be fine and I will get a favorable response.

    My concern is whether I should apply for 485 or should I wait till 140 approval to apply for 485.

    please advice.

    I also got an I-140 REF on A2P. USCIS requested my company's 2006 Tax Return, my 2006 W2 and 3 latest pay stubs. I am still waiting for my employer's tax return, However I am going to apply I485.

    i just called DOS. He asked for my visa type and passport number. He said "your visa has been issued in Jan. Call the New Delhi consulate and they should let you know if it would come through mail or do you need to go pick it up"

    what happens next ?? how long after this stage it takes to get the visa ?? are there any other checks that could be going on ?? ONCE DOS approves are there any other agencies like FBI, KCC doing some other approvals as well ?? if you know what happens next let me know..waiting for posts..

    so now i know I am not stuck due to PIMS and DOS cleared and approved my visa in Jan..what else then ??

    What is this reverse brain drain ? there is no such thing - folks who are here are going to hang on tooth & nail to stay here come hell or high water - the only ones who are going back are the ones who have no other option. That is not true. In fact I would say that many people who leave have lot of guts. they may have other priorities like family, social etc. I know many naturalized US citizens who have sold their homes and are / about to go back. some IITians left because of green card issues (one of my friend tried to apply ..company was laying off H1B's ..he moved to NY financial company and now is in India at higher post. in the end it is priorities that you have in life.

Others names in your list have not been working in IV since long time � 2006. So don't know how to respond to your question about any of the other names.

    Advocacy is a long drawn process and we do not think it is the best interest of our effort to declare on-going advocacy efforts on the forum even when it means that we will not be able to quench the curiosity of some of the members. It will hurt our cause if we continue to announce advocacy effort details on the forum.

    Periodically communicating with members stuck in green card backlog in your community/state takes just couple of minutes in a week and is not demanding at all. This channel takes extremely less time to update yourself with what is going on. So that is the channel we are following at this time to share information. As such we request you to please join the group/team in your local area and use that channel to get the updates. When there is an update that can be shared on the forum, we do post the update for all the members.

    I received my green card in June-07 and shared this information on the forum earlier. There is one other member who received green card in past few months but for the purpose of privacy it is better for the member to have the choice if/when to announce on forum. I hope you understand and appreciate if someone decides not to announce a specific personal information on the public forum. No other member of core team have received their green card and regardless of the fact whether we have received the green card or not, we continue to do everything possible to work on fixing EB green card delays/backlogs.

    Like I said, you have to give some credit to the Irish. They have the chutzpah of going to lawmaker's offices in DC and say "I am an illegal...I broke the laws and overstayed my visa...please change to law to make everything ok again for me please...". And our community thinks that someone is listening to their phone conversation about how to raise money and lobby for the legal immigrants?????

    I think it all boils down to how desparate we are for GCs, many people here on H1 just want to count their valid H1 visa and multiply them by thier montly savings,

    but Irish and many illegals itz a do or die situation they are smart people to knock on law makers door, before law-enforcing people knock on thier doors

    Yes IV members and other EB folks who are/will benefit(ing) from this are indebted big time to Aman and IV core. Com'on guys this fellow sold his house and spends a good chuck of his time for a selfless cause.     Second the idea of using an ATM card for this purpose. You can get an ATM card for your parents or relatives in India from your local credit union or bank in the US.

    How does this ATM thing work? Do you give your family in India your own ATM card/PIN or do you request the credit union to issue ATM cards for your family.

    I just checked with the credit union I have account with and they said, to issue ATM cards to anyone else they (the person) should have SSN# and they should be made joint account holders. This is not possible when you are planning to give the ATM cards to people in India right?

    :) wait till september, i betting we will see 25-28k eb2 approvals, good for them i guess. it is typical with USCIS, towards the end of the year they wake up and go overtime in approving the cases.

    I wonder why USCIS/DOS don't spread the workload across consular posts. During Jul2007 fiasco, most of the I-485 application till Jan'2007 PDs are filed. Now if DOS make the PD for all categories to lets say 2006, they won't recieve any new applications and consular posts could use some numbers.

    In fact, people who opted for AOS will also go for CP if consular posts can process them. This will help take some workload off of USCIS. But I don't know why they don't do it.

    There are both advantages and disadvantages, but if you haven't consumed full 6 years of H1B, going on EAD has certain advantages.

    Even my company recommends to use EAD to stop utilizing H1B time.As per http://immigration-information.com/forums/showpost.php?p=18946&postcount=28 it's definitely better to switch to EAD.I used 4.5 years of H1B and switched to EAD.
