Hi,
I am currently on h1b visa without a project from past 1 year in US and my employer asked me to convert to L2 visa dependent on my husband who is on L1 visa . I do not have any paystubs for my stamping. If I go to canada consulate for stamping, what is the success rate for my visa being approved?Will I be able to come back to US without any issues.Also, can you suggest me to which consulate should I go for my stamping?Please help!

Pls. google USCIS pages for official info. You cannot stay for more than 6 months away from US each year every year. The situation might be different if its a US based company abroad.

Can you at least produce the extension receipt at the embassy? Is your job title IT Consultant? If the answers are no and yes, personally I would not risk it. Of course this is nothing more than a personal opinion. My H-1B expires in April. I waited for the past 3 months and got my extension approved so I'm going back to China this month.

IV Folks,
There are a bunch of people who want to send webfaxes, but they don't want to register.. these are green card holders.. please change it so that people cn just type in their NAme and address instead of registering like numbersusa.org

Thanks for the reply. What I understand even there is no position for EB2 currently, EB2 can be filed for future employment.
Do you know anybody who was in the same situation and converted from EB3 to EB2.

Here's the press release for the new Leica Digilux two.
My observations:
1. The hot-shoe is near the left corner, similar to F2AS. This implies ...
2. The odd looking middle top plate must be for data display
3. It's no Leica-M, corners not right, much thicker body, lacks view windows, ...
If not for the Leica and Leitz words, it can easily be mistaken as a Rollei!

Q1) I would like to take a US consulate appointment for visitor's visa for my father. We are from southern Andhra Pradesh and Chennai consulate is convenient for us. Since Hyderabad has US consulate, does whole of Andhra come under HYD consulate jurisdiction? or can we take appointment in Chennai Consulate? Could you please let me know? My father is going for visa for the first time.
Q2) If visitor passport is expiring in next eight months and if the visitor is residing in US, is it possible to renew the passport here? Or the person has to go back to India and renew the passport there. I would just like to help my parents with the paper work and get it done if possible when they are here.
Your help is appreciated.

Hello IV members,
I have been watching IV forum during the last four weeks. I feel it is a great place to post questions and comments to help everybody in our long Immigration journey. I have a situation here.
I have filed my H-1B extension, my wife�s H-4 extension, my I-140 and our I-485 applications recently from my current address. I haven�t got the approvals yet for any of them. I am thinking of taking another project(with the same employer of course) next month and relocating to a new state.
I heard that immigration documents don�t get forwarded by USPS. My worry is about my wife�s H-4 extension approval notice as other communications will go either to my employer or lawyer. I know that we have an online form to update our new address to USCIS.
Did anybody run into problems of mails being sent to the address in the forms even after you filled out this form?
Please let me know what you think about relocation after filing immigration papers.

Very legitimate question- don't know if anyone here will have a good answer (I hope so) but I hope you get your problem solved. I would advise a consultation with a good attorney, this is a very important matter for you. Some attorney's will answer an initial question free on the web- gives you some preliminary info.

You can stay out of the US for up to 6 months with no consequence, as long as the person has a vaild green card and passport. Over 6 months contact with the US consulate is needed and the green card holder can stay out of the country for up to a year. Over a year the green card holder will forfeit their green card and not be allowed to re-enter the country.
The US permanent resident CAN stay out of the country for more than a year if they apply for and are granted a re-entry permit by USCIS prior to leaving the country. However, for a PR to become a citizen, he/she must have 5 years of continuous residency and staying abroad for more than a year will typically break it regardless of whether a re-entry permit is issued/used.

i know that the immigration officer at the port of entry asks "How long have u been outside the US?" In my case it will be one year and one week so can i just say "about a year"

...I saw online the following message for I-140( I don't know what RFE was about:
Current Status: Response to request for evidence received, and case processing has resumed.
"On January 24, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done."
My notice date for I-140 is Oct. 4th 2007 and receipt date is August 16th 2007...I've done my fingerprints in december 2007...my question is:....
......does it mean that Uscis will approve or deny I-140 within 60 days like they said above...even though the processing times for I-140 in Nebraska is Jan 2007?
What does the above message mean?

Could someone clarify this please? Anyone faced a similar situation?

OK, now I understand the question. Even after PERM was implemented, the person being substituted on an LC included a new ETA 750B with the I-140. Since you already have a lawyer working on this, it would be better to ask him/her if you need more details.

One lawyer told me that according to new regulations only jobs on Job Zone Five can apply for EB2. If this is true only 15-1011.00 - Computer and Information Scientists, Research can apply for EB2 for ITJobs.
Anyone knows if this is true?
I am in Job Zone 4 as a Computer Software Engineer and want to apply under EB2. But if this new rule is true I do not want to apply under EB3 and prefer to go back to my country.
