For that somebody has to have experience of filing two PERMS, almost identical except for the experience requirement. I doubt many people have such an experience

Your H1B is tied to your current company. If your new employer wants to hire you, they have to file a separate H1B for you.

So your answer should be. "I need H1B sponsorship to work."

"I would like to hear your professional opinion on the following issue: I have been on F-1 visa for 7 consecutive years. I have an employer that has sponsored me as a Graphic Designer. In fact I have obtained the I-140 through him already. I recently applied for employment AOS (July 25th) with my wife (She is on F2 visa) and I'm currently waiting on the Notice Receipt. School starts on August 20th and I'm hesitant on when exactly the new Immigrant Status starts. Do I still need to enroll for classes in order to maintain my visa? I don't intend to finish school due to financial difficulties, when exactly may I drop out from school? Should I remain enrolled up until I receive the EAD and AP? Thanks in advance for your response."

off the top of y head and based on what I've read, a D70 is well worth it, even from a D100. A D2H is now cheap too. With lots of Nikon glass the options are quite good. Even a Kodak SLR/n is a good buy.....

I did my 7 th year visa transfer this year and again it took more than 2 months then nothing happened later I went for premium processing because my wife's H4 stamping date was coming closure. I guess usually it takes 2-3 months for transfering visa. Mine was Nebraska Service center. Again this year I am going for 8th year extension. Good luck for your visa transfer. Just relax and wait for USCIS reply on ur application.

Guys,
I am currently working as Programmer Analyst for a company who is currently doing the GC. I have been with them for about 7 years.

Starting next month I am going to use my H1 7th year.

I am pondering about a new offer Firmware Engg. My GC detaisl are below:
PD: 06/2003 -- EB3
Education: MS

I am planning to stay in H1B, if possible with the new employer. But thinking of doing PERM and see if I can port my earlier date during I-140 filing.

Any suggestions or recommendations ...

yes still labor transfer is possible ..But you have to very carefull.. you need to find what was companys financial position at that time when labor was filled. wheather you were fullfiling your experience as required in Labor at that time... and you need to check the companys situation if it is not blaclisted by DOL.

It is just my openion you can check with attorney's.

Hello all,
I am a student on an I20/M1 vis
I have just recieved a new I20, and sent a form I 539 for extension of my I20.
I have my old I94, I20 etc.
It is currently under processing.
First, is there any way they can move it to another processing center? Its in the vermont center right now, and they are still processing documents from May 2008 according to CIS website.
Second, my original I94 is valid till 14 April 2009 but my original I20 is expired.
My visa is 5 years(M1 valid to 2013)
Can I go and visit my home country with the old I94(since its valid long enough) and new I20(which just got issued)??
or do I need to wait until the processing comes through?

I think as long as you have valid visa and new I-20 you should be fine.

These questions are easily answered by school officials. Get a apointment and get a quick answere from your International student office.

My I140 was originally filed at California service center, on 3/24/2006 it was transferred to Texas service center.


was it automatically transferred ?
