Eb3Nepa is very much here from initial days of this organization and supported the cause alot, even more than main members(So called..) here.
That is how he knows the core team members names/handles, even lot of you do not know them...
Only 1 or 2 members are here from initial 12+ core members..That is another thing though.
Anyway, as others mentioned, people have to move on..and this movement is just not by core members but by all. Core members comes/goes, after their journey, unless they have some agendas. (In the +ve way)

My lawyer put in a SR on Sept 1. On Sept 11 i recd. the email saying that i was approved. My situation was similar to yours. Same company for 8 years, no RFE - infact no updates on my online status since Sept 2007 when it was first updated to reflect the fact that the application was recd at NSC. So i am assuming that SR triggered review of the application but with USCIS who knows.
Hopefully you will get your approval soon if my case is any indicator (admitted the sample size = 1)

Like I said, you have to give some credit to the Irish. They have the chutzpah of going to lawmaker's offices in DC and say "I am an illegal...I broke the laws and overstayed my visa...please change to law to make everything ok again for me please...". And our community thinks that someone is listening to their phone conversation about how to raise money and lobby for the legal immigrants?????
I think it all boils down to how desparate we are for GCs, many people here on H1 just want to count their valid H1 visa and multiply them by thier montly savings,
but Irish and many illegals itz a do or die situation they are smart people to knock on law makers door, before law-enforcing people knock on thier doors

I wanted to add a few points again - after reading the previous posts from Alien2006 and Chanduv23.
To alien2006' posts I want to add the following:
Funny how many of us have noticed the flow of suggestive ideas that we are given right from the time we start the H1 process - back in our home country:
1. Prospective H1 employer suggests the following (nothing in writing of course):
"Great. You are very smart and deserving. We have choosen you to be one of the lucky few whom we will take to America this year after filing your H1-B visa. Once you land there on the H1-B visa, everything will be great. You will have a job in a few days with one of our clients (Buzzer - this is one heck of a lie - there are no confirmed jobs - one has to go through the whole process of interviews again to find a project where you will be accepted on a contract position. Rarely I have seen H1 companies who have projects of their own for their employees...but no one tells us that!!!). After you have worked with us for about 6 or 7 months we will file your green card and you will have your green card within 3 - 4 years. You will be all set with the wonderful American Dream in less than 6 years which is the validity of your H1 visa!!!. (Buzzer - One more great turd of BS - Yes they will apply our green card...BUT they may or may not pay for it...they will apply but there are 195,000 H1s and only 7000 Green cards per year for India - guess what MOST OF us will only dream of a green card and may never get one).

The Article clarifies that that Congress has the power to regulate immigration. they used the power and created the INS laws we have today, which as per Congress is the hallmark of US immigration. We have to change those laws specific to EB.
You are muddling immigration laws with civil rights. Your argument about the current law being in violation of ANY constitutional right is completely baseless. You did not respond to my question about how the civil rights clauses you quoted have anything to do with immigration.
There are far too many points here to address at one go. Let me touch upon this for starters:

I submitted usps money orders for I-485 fees. Filed on july 2nd.
Any way to find out if those money orders are enchashed or no?

The only way to track tme money order is after 60 day from bying it. You can go to the post office and they will invistigated. it cost 5 dollars. They wont do it before 60 days. i went and asked.

I have a question. My Firm is a really small one, just 1 employer + my = 2. The tax returns are not so good, becouse all the money was invested in a second business. The firm started in June 2005. The Firm has ca. $65.000 in a saving account. My salary will be $2000/month. Will be enough this $65.000 for the USCIS, for the Ability to pay.

People choose to come here for plenty of different reasons: professional, economical, family or a combination of everything.
Yes, France is a developed and rich country and, if I had stayed there, I would certainly be today in a much better situation, professionaly and financially!
So, I certainly did not come here for the $$. It is extremely simple: it was just my childhood dream to live here and I am proud today that I made it.
Yes, I had to go through that ordeal and I did not "choose" to do it, it just happened. I was just stuck in that infernal situation.
Would I do it again, even to fulfill my dream? Certainly not, I am not that mad. Will it prove worth it eventually? I don't know yet.
The truth of the matter is: how do you know in advance what lies ahead?
If we always knew, life would be too easy, don't you think so?
Nobody would make mistakes or wrong choices.
So, was I right or wrong to go through all this? Well, again, I don't know.

What an inspiring story. Thank you for wriitng the timeline so carefully. After years of being sad I've joined a gym and I am a happier ..and yes, a slightly thinner person!

Guys, guess what I am holding in my hand? Yes, that bit of plastic, object of our fantasies �.and nightmares. After filing Writ of Mandamus on November 1st, things went amazingly quickly and smoothly: on December 1st, the US attorney gave confirmation that the case has been approved and I received the card in the mail on 12/07.
What did I feel then? Really indescribable�Happy? It goes way beyond that.
I feel more relieved than anything else, like if I had a ton of lead off my shoulders�
May my story inspire, give hope and faith to all of you guys who are so depressed at the moment because of what happened, or did not happen should I say, in that shameful Congress.
As you will see, I had my head in a brick wall more than once. More than once, I was devastated and, still, I never gave up and made it through.
So, please, enjoy the holidays: as long as there is life, there is hope.
I know something about it:
Come here in 1993 as a student on F1 visa. Graduate and got Work Permit (OPT).
Find dream job in dream company. Hired directly by CEO himself.
Company loves me and applies right away for H1 and then Labor Cert.
Life is beautiful. The start of the American Dream. Not for long.
Attorney has been working for company for years. Always successfully.
Picks me for his first failure: screws up completely.
H1 denied. Labor Cert denied. Company gets mad: attorney is fired.
OPT runs out: company still loves me but�I am now out of status and�fired too.
Welcome to America. Life has turned dark. The start of my American Nightmare.
I am disgusted. Decide to go back to my home country (France).
I miss California. Find new company that loves me: apply for H1 again (this time, I am paying all fees, out of my meager savings).
H1 is approved, got stamp at embassy in Paris. I am back. Life is beautiful again.
Not for long. Exactly 2 hours (no kidding).
Find out that company is a sweat-shop and boss is a crook.

I am broke. Can�t even go back �home� and anyway I don�t want to.
Not with just my tail between my legs for the second time.
Home is here. I want my American Dream and I will get it, no matter what.
Decide to swallow my pride and endure the humiliation until I can find new employer willing to sponsor new H1 and pay all fees. I just can�t afford anything as I am hardly surviving.
Employer wants to fire me: �you are always complaining about the money�.

Get EAD. FP in September 2004.
Things change: company is now going down. Boss still loves me but�lays me off.

Attorney says: �Don�t worry (!!!) Employer loves you. Won�t revoke I-140. GC is for future job. Find new H1 job to maintain status and see what happens�.
This time, I am lucky (!) and find right away new H1 job. Company is OK, job is OK.
Later, previous company nicely recovers: got rehired!
Only thing: I will have to pay all fees from now on. Don�t care. Back on the right track.
Do Medical in April 2005.
I-140 approved in May 2005�but visas are now �Unavailable�. Nothing to worry about.
October is around the corner and new numbers will be available, right?
Just a few more months and I will have my GC. Wrong.
October bulletin comes out. EB3 World is back to March 2001 (PD is 01/2002).

Like most people involved in that GC mess, I refused to worry in advance.

Weirdly enough, I am now almost relieved. Why? Because for the first time ever, I can be proactive and I CAN ACT!
I call my lawyer and tell her about those 2 e-mails: �That�s good enough to file Writ of Mandamus. That summarizes the whole situation, we don�t need anything else�.
WOM is filed on November 1st.
(I requested FOIPA and contacted Senators, President, Vice-President etc, etc�
only later just in case we would have needed more ammunitions).
After that, things go fast:
11/ 29: without any warning (!), LUD: �Your card has been ordered�.
12/01: confirmation from the Assistant US Attorney that my case has been approved.
12/04 LUD: �Your case has been approved�.
(So, they notify you that the card has been ordered�before notifying that the case has been approved�).
12/05: receive Approval Notice in the mail and my attorney indicates that she will then dismiss the Mandamus complaint.
12/07: receive the Magic Card in the mail (regular mail, even not certified, unbelievable�).
What a timing! Could I dream of a better Christmas Gift?

Guys, guess what I am holding in my hand? Yes, that bit of plastic, object of our fantasies �.and nightmares. After filing Writ of Mandamus on November 1st, things went amazingly quickly and smoothly: on December 1st, the US attorney gave confirmation that the case has been approved and I received the card in the mail on 12/07.
What did I feel then? Really indescribable�Happy? It goes way beyond that.
I feel more relieved than anything else, like if I had a ton of lead off my shoulders�
May my story inspire, give hope and faith to all of you guys who are so depressed at the moment because of what happened, or did not happen should I say, in that shameful Congress.
As you will see, I had my head in a brick wall more than once. More than once, I was devastated and, still, I never gave up and made it through.
So, please, enjoy the holidays: as long as there is life, there is hope.
I know something about it:
Come here in 1993 as a student on F1 visa. Graduate and got Work Permit (OPT).
Find dream job in dream company. Hired directly by CEO himself.
Company loves me and applies right away for H1 and then Labor Cert.
Life is beautiful. The start of the American Dream. Not for long.
Attorney has been working for company for years. Always successfully.
Picks me for his first failure: screws up completely.
H1 denied. Labor Cert denied. Company gets mad: attorney is fired.
OPT runs out: company still loves me but�I am now out of status and�fired too.
Welcome to America. Life has turned dark. The start of my American Nightmare.
I am disgusted. Decide to go back to my home country (France).
I miss California. Find new company that loves me: apply for H1 again (this time, I am paying all fees, out of my meager savings).
H1 is approved, got stamp at embassy in Paris. I am back. Life is beautiful again.
Not for long. Exactly 2 hours (no kidding).
Find out that company is a sweat-shop and boss is a crook.
Pays me half (yes, half) what he was supposed to.
Go to INS to complain: �If you are not happy, go back to your home country�.
I swear that it is exactly what I am told.
Consult attorneys for a possible lawsuit: � Alas, your situation happens more often than you can imagine. Many unscrupulous employers use and abuse of would-be immigrants like you. Don�t waste your time and money in a lawsuit, just find yourself a new job�and be more careful this time�.
I am broke. Can�t even go back �home� and anyway I don�t want to.
Not with just my tail between my legs for the second time.
Home is here. I want my American Dream and I will get it, no matter what.
Decide to swallow my pride and endure the humiliation until I can find new employer willing to sponsor new H1 and pay all fees. I just can�t afford anything as I am hardly surviving.
Employer wants to fire me: �you are always complaining about the money�.
I have to threaten him (yes I did) to report his company to Dept. of Labor (most his employees are illegals and as abused as I am, not getting paid for overtime and so on�).
Imagine in what kind of atmosphere I am working�but I need this job to remain legal until I can find something else.
For sure, I will be out of there within a couple months at the most.
Don�t know yet that this nightmare will last�2 years. Still can�t believe it.
Had I known, I would have fled the first day, no matter what.
In my specialty, jobs are not easy to find.
Not to mention that this time, I have to be very �choosy��
Companies that I approach:
a) don�t want to hear about immigration or
b) don�t want to pay attorney fees or
c) don�t want to pay at least prevailing wage or
d) all of the above
All doors seem to be closed.
I have never felt that bad in my life: go see the doctor.

Some of us are in Eb3 because of our experience, some of us are in EB3 because of circumstances (I had 7 years exp when my GC was files, but 3 years out of it was spent as consultant in my current employer place. Hence we could use only 4 years as exp and hence EB3), some of us are in EB3 because of lazy lawyers.
We cannot blame EB2 or any other category for thinking for themselves. That is just human nature. I have done everything to support IV and will continue to do so, be it letters, faxes, calls or money. But I also know that no one is going to fight for Eb3-I. Once my EB2 friends get their GC, there may be no IV remaining. That is OK with me. I will still contribute.
All I want from EB2 people is to stop making fun of EB3 cracking jokes about losers, etc. You never know when destiny takes a U-turn. It may as well happen that all EB3-I get their GC and the joke crackers never get it. So please, EB2 should enjoy their forward movement of dates. But please do not make fun of EB3-I.

Here's an anecdote -
This was back in the late 80s, when I was growing up - in Bangalore.
India had just lost the Finals of a well fought [field] hockey match to Pakistan. We were all very disappointed by the loss, but it saddened me further to see a victory procession with waving Pakistani flags in the Muslim parts of the City.
Ofcourse, India is a secular country and more so the United States.. and you can cheer whoever you please..
But, If you chose to become a US Citizen, and US were in a battle with your country of Origin (let's narrow it down to Sports, to keep it less complicated), which country would you side? If I chose to side with my country of origin, it would make me a hypocrite, wouldn't it ?

Thanks ak27... based on your suggestion, I have started enquiry on my case through congressman.
I also talked to second level I/O and she told me that it may be due to pending biometrics (what a relief to hear that). She didn't give me any other details so still not sure what's going (no SLUDs yet). I haven't recd any finger print notice since my first one in sep'07 so that kind of makes sense.

i would wait a few months unless i had cash and could get substantial discounts...of course you may already have a great deal that you want to close...however, at a 12% rate, you have to be careful....lots of people will be looking to sell their flats soon...and there may be a temporary downturn in the market that you can take advantage of..get all your paperwork ready...but wait a bit to pull the trigger...

As per our lawyers, right now USCIS is in the process of entering our applications in their system (for date of receipt and such). There was a memo from USCIS saying that they will be done with the job of data entry by August 1.
From August 1, we can expect either rejection or acceptance of the actual application. The hope is that a court/congressional intervention before August 1 will change the USCIS action of rejection into acceptance.

I am 2007 PD EB3. I know i am screwed :-) , but our discussing out unfortunate luck here , wont change it.
I am not even dreaming about my GC. I am just enjoying my life today, as i have no control over tomorrow. The irony , i was qulaified for EB2, but my lawyer didnt want to do an extra work(BS + 7 Years) , so he put me in EB3.
Let EB2 get there GC's first , and may be the illegals also get it before EB3, I really dont know the point of discussion of this thread.
Thank God somebody didnt write , thats its really unfortunate that we were born in India.
